How to Select a Good Immigration Lawyer

A lawyer has skill, experience, and expertise. Lawyers are trained in law school, updated by reading regarding changes in the law, and from experience practicing law. Unfortunately, there is no guarantee that the lawyer truly is as competent as he appears.

An effective method of selecting a lawyer is by recommendation from a satisfied client. Beware that cases are different and are determined by the USCIS on a case by case basis. Also keep in mind that people have different personalities and some people may not get along as well as others. At minimum however, you would know that the attorney has experience in the field of Immigration law.

Another extremely effective manner of choosing an attorney is through articles and Press Releases he or she may have published. An attorney that is capable of writing regular articles and Press Releases is obviously experienced in the field of law he is writing about. This is a good method of assuring that the attorney you are selecting has experience and knowledge in the field of law you are needing representation for.

Upon speaking with the attorney, you may also notice whether the attorney is intelligent, patient, understanding, aggressive, or any other qualities you may notice. You would then also have a better understanding of the attorney’s personality and more information on which to base your decision.

Cost of attorney fees should not be a determinative factor in your decision to hire a lawyer. An attorney who charges low attorneys fees may not have enough staff and equipment to do a priority job. It may turn out to be a “mass-production” law firm in which the paralegals do all the work and the client is treated as a case number. However, a high attorney fee is also not a guarantee of experience or quality work. Some attorneys even quote a fee up front and then add extra charges as the case progresses. Make certain to ask what the price quoted by the attorney includes and whether you should expect any extra charges. Make sure to get it in writing.

Once you retain the Law Firm, make sure to obtain a copy of the Retainer Agreement in which the services, attorney fee, and payment plan are included. If you are not given a copy of the Retainer Agreement, make sure to ask why.  However, do not think the Retainer Agreement is a sort of warranty on your case. All cases are different and subject to change depending on the facts in the case and the law as the case is being processed. The Retainer Agreement is a contract between the client and the Law Firm which guarantees that the client will pay the listed amount and the Law Firm will deliver its Legal Representation upon receiving payment as listed on the Agreement. Remember, it is illegal and unethical for an attorney to guarantee success in your case.  However, the attorney can give you an idea of your probability for success. If the attorney guarantees you any sort of success, you have cause for suspicion and should seek a second opinion.

Lastly, remember that a notary or paralegal is not an attorney, does not have the same rights or responsibilities, education, experience, or authority. An attorney has attorney-client privilege which thereby protects the confidentiality in any facts you provide to him. In addition, a lawyer has a doctorate in law in addition to years of experience in the field. Hence, he knows how to practice the law and how to keep updated with the many changes in the field of Immigration law, and how to help you win your case.
